1. USER INFORMATION

Who is responsible for the processing of your personal data?

ECOPE INFORMÁTICA S.L. is the CONTROLLER of the processing of the USER’s personal data and informs them that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), and Organic Law 3/2018, of 5 December (LOPDGDD).

For what purpose do we process your personal data?

To maintain a commercial relationship with the user. The operations envisaged for carrying out the processing are:

Sending commercial advertising communications by email, fax, SMS, MMS, social media or any other electronic or physical means, present or future, that enables commercial communications to be made. These communications will be carried out by the CONTROLLER and will be related to their products and services, or those of their collaborators or suppliers, with whom they have reached some promotional agreement. In this case, third parties will never have access to personal data.

Carrying out market research and statistical analysis.

Processing orders, requests, responding to queries or any type of request made by the USER through any of the contact methods made available to them on the CONTROLLER’s website.

Sending the online newsletter about news, offers and promotions in our activity. On what legal basis can we process your personal data?

Because the processing is legitimised by Article 6 of the GDPR as follows:

With the consent of the USER: sending commercial communications and the newsletter. By legitimate interest of the CONTROLLER: carrying out market research, statistical analysis, etc. and processing orders, requests, etc. at the request of the USER.

For how long will we keep your personal data?

They will be kept for no longer than necessary to maintain the purpose of the processing or where there are legal provisions dictating their custody, and when it is no longer necessary for this purpose, they will be deleted with adequate security measures to guarantee the anonymisation of the data or their total destruction.

To whom do we disclose your personal data?

No disclosure of personal data to third parties is envisaged except, if necessary for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

The rights available to the USER are:

Right to withdraw consent at any time.

Right of access, rectification, portability and erasure of their data, and to restriction of or objection to its processing.

Right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

Users, by ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly and freely and unequivocally accept that their data is necessary to attend to their request by the provider, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the CONTROLLER is accurate and takes responsibility for communicating any changes to it.

The CONTROLLER informs that all data requested through the website is mandatory, as it is necessary for the provision of an optimal service to the USER. In the event that all data is not provided, it cannot be guaranteed that the information and services provided will be fully adapted to their needs.

3. SECURITY MEASURES

That in accordance with the provisions of current regulations on the protection of personal data, the CONTROLLER is complying with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under their responsibility, and manifestly with the principles described in Article 5 of the GDPR, by which they are processed in a lawful, fair and transparent manner in relation to the data subject and adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The CONTROLLER guarantees that they have implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has communicated adequate information to them so that they can exercise them.

SOCIAL MEDIA PRIVACY POLICY

1. USER INFORMATION

Who is responsible for the processing of your personal data?

ECOPE INFORMÁTICA S.L., hereinafter referred to as the CONTROLLER, informs the USER that it has created a profile on the Social Media platforms Facebook, Instagram, Twitter, LinkedIn, Youtube, Vimeo and Google+, and is responsible for the processing of the user’s personal data carried out on said social media platforms, and informs them that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), and Organic Law 3/2018, of 5 December (LOPDGDD), for which reason the following processing information is provided:

For what purpose do we process your personal data?

Purpose of the processing: to maintain a relationship between the USER and the CONTROLLER which may include the following operations:

Processing requests and queries submitted to the controller

Informing about activities and events organised by the controller

Informing about products or services offered by the controller

Interacting through official profiles

On what legal basis can we process your personal data?

Legal basis for the processing: Article 6.1.a GDPR, the data subject has given their consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER’s social network thereby showing interest in the information published on it, therefore, at the time of requesting to follow our official profiles, they provide us with their consent for the processing of those personal data published on their profile.

The USER can access the privacy policies of the social network itself at any time, as well as configure their profile to guarantee their privacy.

The CONTROLLER has access to and processes the USER’s public information, in particular their contact name. This data is only used within the social network itself and will only be incorporated into a CONTROLLER file when necessary to process the USER’s request.

For how long will we keep your personal data?

Data retention criteria: they will be kept for as long as the USER does not revoke the consent given as indicated in this privacy policy.

To whom do we disclose your personal data?

Disclosure of data: the information provided by the USER through the CONTROLLER’s social media, including their personal data, may be published, always depending on the services used by the USER, and may therefore be made publicly available to other third-party users of the social media platforms. From each social network’s profile, the USER can configure what information they want to make public in each case, view the permissions that have been granted, delete or deactivate them, as with any third-party application they no longer wish to use.

No disclosure of personal data to third parties outside the social network is envisaged except, if essential for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

Rights available to the USER: these may only be satisfied in relation to information that is under the control of the CONTROLLER.

2. USE OF THE PROFILE

The CONTROLLER will carry out the following actions:

Access to public profile information

Publication on the USER’s profile of all information already published on the CONTROLLER’s social network

Sending personal and individual messages through social network channels

Page status updates that will be published on the USER’s profile

The USER can always control their connections, delete content they are no longer interested in and restrict who they share their connections with; to do so they must access their privacy settings.

3. PUBLICATIONS

The USER, once they are a follower or have joined the CONTROLLER’s social network, may publish comments, links, images, photographs or any other type of multimedia content supported by it. The USER, in all cases, must be the owner of the published content, hold copyright and intellectual property rights or have the consent of the affected third parties.

Any publication on the social network is expressly prohibited, whether texts, graphics, photographs, videos, etc., that violate or are likely to violate morality, ethics, good taste or decorum, and/or that infringe, violate or breach intellectual or industrial property rights, the right to one’s image or the Law.

In these cases, the CONTROLLER reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The CONTROLLER shall not be held responsible for the content freely published by a USER.

The USER must bear in mind that their publications will be seen by other users, and therefore they themselves are primarily responsible for their own privacy.

The images that may be published on the social network will not be stored in any file by the

CONTROLLER, but will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL CAPACITIES

Access and registration through the CONTROLLER’s social media is prohibited for those under 14 years of age. For their part, if the USER has special capacities, the intervention of the holder of their parental authority or guardianship, or their legal representative by means of a valid document proving representation, will be necessary.

The CONTROLLER shall be expressly exempt from any liability that may arise from the use of social media by minors or persons with special capacities. The CONTROLLER’s social media does not knowingly collect any personal information from minors, therefore, if the USER is a minor, they must not register, use the CONTROLLER’s social media or provide any personal information.
